![]() None. Minimum energy efficiency standards for state buildings established by rule--compliance required--exemption, when. 8.812. 1. By January 1, 2009, the department shall establish, by rule, a minimum energy efficiency standard for construction of a state building over five thousand square feet, substantial renovation of a state building over five thousand square feet when major energy systems are involved or a building over five thousand square feet which the state or state agency considers for acquisition or lease. Such standard shall be at least as stringent as the International Energy Conservation Code 2006, or the latest version thereof. 2. All design which is initiated on or after July 1, 2009, for construction of a state building over five thousand square feet or substantial renovation of a state building over five thousand square feet when major energy systems are involved or any building over five thousand square feet which the state or state agency considers for acquisition or lease after July 1, 2009, shall meet applicable provisions of the minimum energy efficiency standard. 3. The commissioner of the office of administration may exempt any building from the requirements of subsection 2 of this section: (1) When compliance with the minimum energy efficiency standard may compromise the safety of the building or any of its occupants; or (2) When the cost of compliance is expected to exceed the projected energy cost savings gained. |

![]() Missouri does not have a statewide building or energy code. Each local jurisdiction has the authority to adopt its own code. In most cases, local jurisdictions have adopted the Building Officials and Code Administrators (BOCA) International, National Building Code (NBC), although the western part of the state has adopted the International Conference Building Officials (ICBO), Uniform Building Code (UBC) and a few localities in the southeast use the Southern Building Code Congress, International (SBCCI) Standard Building Code (SBC). Missouri General Assembly passed a bill that would allow the county commission of any county to adopt a building code subject to voter approval. In creating or amending such code, a current calendar year 1999 or later edition nationally recognized building code must be adopted. (Section 64.180, RSMo). The Governor's commission for the Review and Formulation of Building Code Implementation presented its recommendations to the Governor on December 1, 1999. They include recommendations: To allow third class counties to be given the authority to adopt a building code. To require all jurisdictions already operating pursuant to an adopted model building code to update its code so that it is current within one model code edition of the latest such code published by that model code organization. To require the family of International Codes to be the codes adopted when those areas that do not have codes decide to adopt codes. That the Legislature pass legislation to create a Missouri Building Code Review Commission to provide advice to the Governor and Legislature on building code issues affecting the state. |
